1. Acceptance
By downloading or using the WindWindow mobile application (“the App”), you agree to these Terms of Service. If you do not agree, do not use the App.
2. About WindWindow
WindWindow is a wind forecast and alert application developed and operated by Tom Schouten (“we”, “us”), based in the Netherlands. Contact: privacy@windwave.dev.
3. Not a Safety Tool — Forecast Disclaimer
WindWindow is not a safety tool. Wind forecasts are provided as-is from third-party weather data sources (currently Open-Meteo). We make no warranty — express or implied — as to the accuracy, completeness, or fitness for purpose of any forecast, alert, or data shown in the App.
Kitesurfing and windsurfing are dangerous activities. You are solely responsible for assessing conditions before entering the water. Do not rely on WindWindow as your only source of weather information. Always check local forecasts, heed official warnings, and assess on-site conditions before kiting.
We accept no liability for personal injury, property damage, or any other loss arising from use of or reliance on the App, including inaccurate or delayed forecasts.
4. Eligibility
You must be at least 13 years old to use the App.
5. Accounts
You may sign in with Google or a magic-link email. You are responsible for keeping your account credentials secure. We may suspend accounts that violate these Terms.
6. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose.
- Attempt to reverse-engineer or scrape our API.
- Interfere with the App’s servers or infrastructure.
- Use the App to send unsolicited commercial communications.
7. Intellectual Property
All content, trademarks, and code in the App belong to WindWindow or its licensors. Weather forecast data is provided by Open-Meteo under the Open-Meteo terms.
8. Free and Paid Features
The App is currently free. A premium subscription tier is planned for a future release. Full commercial terms will be added to these Terms before billing is introduced.
9. Termination
You may delete your account at any time via the App. We may suspend or terminate access if you breach these Terms.
10. Limitation of Liability
To the maximum extent permitted by Dutch law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the App.
11. Governing Law
These Terms are governed by the laws of the Netherlands. Any dispute shall be brought exclusively before the competent court in the Netherlands.
12. Changes to These Terms
We may update these Terms. Material changes will be announced in the App. Continued use after the effective date constitutes acceptance.
